Ombudsman
In accordance with Article L. 612-1 of the Consumer Code, consumers, subject to Article L.612.2 of the Consumer Code, have the right to submit a request for amicable resolution through mediation within one year of submitting a written complaint to the professional.
HOTEL PINARELLO has designated, by membership registered under number 53626/VM/2409, SAS Médiation Solution as the consumer mediation entity.
To refer a matter to the ombudsman, consumers must submit their request:
– Either in writing to : Sas Médiation Solution – 222 chemin de la bergerie 01800 Saint Jean de Niost
– Either by email to : contact@sasmediationsolution-conso.fr
– Either by completing the online form entitled ‘Contact the mediator’ on the website : https://www.sasmediationsolution-conso.fr
Regardless of the method used to submit the request, it must contain:
– The applicant’s postal address, telephone number and email address,
– The name, address and registration number with Sas Médiation Solution, of the relevant professional,
– A brief summary of the facts,
– Copy of the prior complaint,
– All documents required for processing the application (purchase order, invoice, proof of payment, etc.)
• The Customer is reminded, in accordance with Article L. 121-20-4 of the French Consumer Code, that they do not have the right of withdrawal as provided for in Article L. 121-20 of the French Consumer Code, since the services are provided on a specific date or at specific intervals.
• In the event of a dispute with Hotel Le Pinarello, the Customer must first contact Hotel Le Pinarello by email. (contact@lepinarello.com ) or by post (3662 Strada di Pinareddu – 20144 Ste Lucie de Porto-Vecchio)
• If the complaint submitted to Hotel Le Pinarello is unsuccessful or if no response is received within two (2) months, the Customer may submit the dispute between them and Hotel Le Pinarello to a mediator (Sas Médiation Solution), who will attempt, independently and impartially, to bring the parties together in order to reach a solution.
• The Customer benefits from the mediator’s website. (https://sasmediationsolution-conso.fr) a complaint form in order to submit their request for mediation. The Customer and Hôtel Le Pinarello remain free to accept or refuse to settle a dispute through mediation, as well as to accept or refuse the solution proposed by the mediator. In the absence of an amicable agreement, the court with jurisdiction to resolve the dispute is that of the defendant’s place of residence or that of the place of performance of the Booking. The Customer may also, if they wish and independently of any other procedure for settling their dispute with Hôtel Le Pinarello, use the online dispute resolution platform offered by the European Union: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage These Terms and Conditions are subject to French law. In the event of any difficulty in interpretation resulting from a contradiction between the French version and any version in another language, only the French version shall be taken into account.
