
Individual reservations
These general terms and conditions of sale apply to all reservations made by customers, subject to any special conditions that may apply to special offers.
These terms and conditions of sale are subject to change at any time, and the applicable terms and conditions will be those in effect on the date the reservation is made.
These general terms and conditions of sale are brought to the customer's attention at the same time as their reservation request. Any confirmation implies the customer's full and unreserved acceptance of these terms and conditions.
Reservations are guaranteed for arrivals until 11 p.m. on the scheduled day of arrival. After 11 p.m., the hotel reserves the right to keep only those guaranteed reservations for which the customer has notified the hotel of their late arrival. In the absence of any notification from the customer, the cancellation conditions will apply to the reservation and the reserved room(s) will be made available for sale.
The customer agrees and undertakes to use the room with due care and attention. Any behavior contrary to good morals and public order will result in the hotelier asking the customer to leave the establishment without any compensation and/or refund if payment has already been made.
We do not accept bank checks or vacation checks.
Rates
Prices are quoted in Euros and include VAT, excluding tourist tax, for a specific number of people per room and for the selected dates. Breakfast and other services are charged as extras per person per day, except for special offers and packages.
Since 2021, the tourist tax set by our municipality is €1.32/day/adult (aged 18 and over), payable on site on the day of your departure.
No stay booked before the introduction of a promotional offer, if applicable, will be eligible for a refund, even partial.
General Terms and Conditions of Booking:
Deposit
A deposit is required for all bookings and is only deductible at the end of the agreement if the latter has been fully executed (Article 1590 of the Civil Code). If the promise to sell has been made with a deposit, each of the contracting parties is free to withdraw from the agreement, the party who gave the deposit by forfeiting it, and the party who received it by returning double the amount.
The payment of the deposit is a determining and substantial condition of the reservation. If the deposit is not paid, the hotel will not be able to confirm the reservation and the availability of the reserved room(s) cannot be guaranteed.
A reservation will only be considered firm if accompanied by a deposit corresponding to:
– 1 night for stays of 1 to 3 nights;
– 40% of the total amount of the stay for stays of 4 nights or more.
Payment can be made by bank transfer, Visa, or MasterCard.
In accordance with Article 1590 of the French Civil Code, the deposit will be retained in the event of cancellation. However, any security deposits paid remain refundable in accordance with the cancellation conditions.
Cancellation policy
Any changes or cancellations to a reservation must be sent in writing by the customer to the hotel (email, mail, fax). The date on which the hotel receives the change or cancellation request is the date taken into account for the cancellation. All requests received will receive a written response from the hotel's Reservations Department.
Cancellation fees
– Between 45 and 31 days before the scheduled arrival date: the deposit will be refunded minus a €30 administration fee.
– Between 30 and 21 days before the scheduled arrival date: the deposit will be carried over to a future stay, provided that the room has been re‑let for the entire period concerned. Otherwise, 20% of the total amount of the reservation will be retained.
– Between 20 and 10 days before arrival: 30% of the total amount of the reservation will be retained, regardless of whether or not we have been able to re‑let the room.
– 9 days or less before arrival: the entire deposit will be retained (i.e. 40% of the total amount of the reservation), regardless of whether or not we have been able to re‑let the room.
Changes
For any shortened stay, delayed arrival, or reduction in the number of rooms, notified less than 30 days before the scheduled arrival date, the canceled nights will be charged at 20 to 40% of the room rate according to our general cancellation conditions above. Once your stay has begun, if it is shortened, the canceled nights will be charged in full.
For reservations made via partner websites, cancellations must be made via those websites. The cancellation conditions that apply are specific to the partner and may therefore differ from those of the Le Pinarello hotel.
In the event of an extended stay, the hotel's general terms and conditions will apply to the additional nights.
Customers are reminded that, in accordance with Article L. 121‑20‑4 of the French Consumer Code, they do not have the right of withdrawal as provided for in Article L. 121‑20 of the French Consumer Code, since the services are provided on a specific date or at specific intervals.
Special Conditions Related to our offers
Reservations with our offers
We require a 40% deposit of the total amount of the stay at the time of booking.
The dates of your stay can be changed with a price adjustment no later than 30 days before the scheduled arrival (depending on availability and pricing periods); in this case, the stay may be postponed before the end of the current season (stays cannot be postponed to the following season).
In the event of cancellation, the amount paid is non‑refundable.
For all reservations, once your stay has begun, if it is shortened, the full amount of the stay will remain payable to the hotelier.
Offer with breakfast buffet included
Any special offer including the breakfast buffet does not allow for the deduction of breakfasts not taken; in the case of room service, the supplement will be from €5 per person.
Arrival/Departure
On the day of arrival, rooms are available from 4:00 p.m. On the day of departure, rooms must be vacated by 11:00 a.m.
Any missing and/or damaged items found in the rooms or in the common areas of the hotel and not reported by the customer upon departure will be charged and paid for by debiting the customer's credit card provided as a guarantee.
Smoking
Please note that smoking is strictly prohibited within our establishment (Anti‑Smoking Law of January 1, 2008). If the smell of cigarette smoke is detected in your room, we will be obliged to charge you €1,000 to cover cleaning costs.
However, you are allowed to smoke on the terrace of your room and in the restaurant‑bar.
Strict prohibition on the use of cooking appliances:
For safety and fire prevention reasons, the use of any portable cooking appliance is strictly prohibited throughout the site.
This includes, but is not limited to:
Failure to comply with this rule may result in penalties of up to €5,000. We thank you for your understanding and cooperation in ensuring everyone's safety.
In addition, in the event of damage to property resulting from the use of cooking appliances, the cost of repairing or replacing the damaged equipment will be charged to the offending customer.
Data Protection
In accordance with Law 78‑17, known as the Data Protection Act, customers are informed that their reservation is subject to computerized processing. Users have the right to access and rectify the data entered, which can be exercised at the head office: SARL HÔTEL LE PINARELLO, Plage de Pinarello, 20144 Sainte Lucie de Porto‑Vecchio. It is specified that this information is not communicated to third parties.
The Le Pinarello hotel offers free WiFi internet access. The customer/user undertakes that the IT resources made available to them will not be used in any way that is contrary to public decency and public order.
The Le Pinarello establishment has a video surveillance system in the common areas of the building.
Visuals
Every effort has been made to ensure that the photographs, graphic representations, and texts provide as accurate an overview as possible of the services offered. Variations may occur, particularly due to changes in furniture or renovations.
Similarly, as nature is wild and changeable, the turquoise color of the water, the sun, and the boats shown in our photographs of Pinarello beach and bay may vary from one day to the next.
The customer cannot make any claims in this regard, as these variations do not affect the essential characteristics of the service.
Pets
For safety and hygiene reasons, pets are not allowed in our establishment.
Liability
In the event of exceptional circumstances or force majeure, the seller reserves the right to accommodate customers partially or entirely in a nearby establishment at no extra cost. In the event of force majeure, unforeseeable circumstances, or circumstances beyond its control, the seller must inform the customer by all possible means in order to limit potential damage.
The seller cannot be held liable for the non‑performance or poor performance of the reservation in the event of force majeure, the actions of a third party, the actions of the customer, or the actions of its partners.
Jurisdiction
Any dispute that cannot be settled amicably and relating to the validity and performance of this contract shall be submitted to the Commercial Court of Ajaccio.
Mediation
In accordance with Article L. 612‑1 of the Consumer Code, the consumer, subject to Article L.612.2 of the Consumer Code, has the right to submit a request for amicable resolution through mediation within one year of submitting a written complaint to the professional.
HOTEL PINARELLO has designated SAS Médiation Solution as its consumer mediation entity, registered under number 53626/VM/2409.
To refer a matter to the mediator, consumers must submit their request:

– Or by completing the online form entitled “Refer to the mediator” on the website https://www.sasmediationsolution‑conso.fr
Regardless of the method used to submit the request, it must include:
– The postal address, telephone number, and email address of the claimant,
– The name, address, and registration number with Sas Médiation Solution of the professional concerned,
– A brief summary of the facts,
– A copy of the previous complaint,
– Any documents necessary for the investigation of the request (purchase order, invoice, proof of payment, etc.).
• The Customer is reminded that, in accordance with Article L. 121‑20‑4 of the French Consumer Code, they do not have the right of withdrawal as provided for in Article L. 121‑20 of the French Consumer Code, since the services are provided on a specific date or at specific intervals.
• In the event of a dispute with Hotel Le Pinarello, the Customer must first contact Hotel Le Pinarello by email (contact@lepinarello.com) or post (3662 Strada di Pinareddu – 20144 Ste Lucie de Porto‑Vecchio).
• If the complaint submitted to Hotel Le Pinarello is unsuccessful or if no response is received within two (2) months, the Customer may submit the dispute between them and Hotel Le Pinarello to a mediator (Sas Médiation Solution), who will attempt, independently and impartially, to bring the parties together in order to reach a solution.
• The Customer can find a complaint form on the mediator's website (https://sasmediationsolution‑conso.fr) to submit their request for mediation. The Customer and Hotel Le Pinarello remain free to accept or refuse to settle a dispute through mediation and to accept or refuse the solution proposed by the mediator. In the absence of an amicable agreement, the court with jurisdiction to resolve the dispute is that of the defendant's place of residence or that of the place of performance of the Reservation. The Customer may also, if they wish and independently of any other procedure for settling their dispute with Hotel Le Pinarello, use the online dispute resolution platform provided by the European Union: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage These General Terms and Conditions are subject to French law. In the event of any difficulty in interpretation resulting from a contradiction between the French version and any version in another language, only the French version shall be taken into account.
